Terms and Conditions - BVPT Online

1. Acceptance of Terms

● By purchasing the BVPT Online Membership, you agree to be bound by these Terms and Conditions.

2. Membership Term

● We may or may not offer a Free Trial period on your membership. A free trial period will not exceed 7 days.  Your membership will automatically commence at the conclusion of your trial period. Certain features may not be available during the trial period.

● Your membership term will be a minimum of 12 weeks, then rollover weekly until such time as you cancel.

● Your membership will automatically renew unless you cancel before the end of your current billing cycle.

3. Cancellation Policy

● To cancel your membership, you must notify us in writing via email at least 2 weeks prior or cancel yourself via this line.

 

● Once cancelled, your membership will be terminated at the end of your current billing cycle.

4. Payments

● You agree to pay the membership fee as stated on the website.

● Payments will be processed automatically on a recurring basis from the initial purchase date.

5. Liability and Risk Waiver.

By enrolling in this membership, you acknowledge and agree to the following:

● Risk of Injury: You understand that participating in any physical activity, including online workouts, carries inherent risks of injury, including but not limited to, strains, sprains, fractures, and other physical harm.

● Assumption of Risk: You voluntarily assume all risks associated with your participation in this program, including any risks that may arise from following the workout plans or nutritional advice provided.

● Medical Clearance: You represent that you are in good physical health and have consulted with a healthcare professional before starting this program.

● Equipment Use: You are responsible for ensuring that you use any equipment safely and appropriately.

● Release of Liability: You release Barossa Valley Personal Training, its employees, agents, and affiliates from any and all liability for any injuries, damages, or losses that may arise from your participation in this program.

6. Refund Policy

● No Refunds for Digital Products: Due to the nature of digital products, no refunds will be issued for membership fees once the membership is activated.

● Exceptions: In exceptional circumstances, such as unforeseen circumstances or technical difficulties that significantly impact your ability to access the program, a refund may be considered on a case-by-case basis.

● Refund Requests: All refund requests must be submitted in writing to [email protected] within 7 days of the purchase date.

7. Intellectual Property

● All content provided within this membership, including workout plans, nutrition advice, and other materials, is the intellectual property of Barossa Valley Personal Training.

● You agree not to share, distribute, or reproduce any of this content without explicit permission.

8. Privacy Policy

● Your personal information will be handled in accordance with our Privacy Policy, which can be found at www.bvpt.com.au/privacy.

9. Modifications to Terms

● We reserve the right to modify these Terms and Conditions at any time. Any changes will be effective immediately upon posting on our website.


Physical Activity Readiness Questionnaire

If you answer ‘yes’ to any of the following questions, please contact Barossa Valley Personal Training

to discuss prior to committing to any exercise plan.

  1. Has your doctor ever said that you have a heart condition and that you should only do physical activity recommended by a doctor?

  1. Do you feel pain in your chest when you do physical activity?

  1. In the past month, have you had chest pain when you were not doing physical activity?

  1. Do you lose your balance because of dizziness, or do you ever lose consciousness?

  1. Do you have a bone/ joint problem that could be made worse by a change in your physical activity?

  1. Is your doctor currently prescribing drugs for your blood pressure/ heart condition?

  1. Do you know of any other reason why you should not do physical activity?

If you answered 'yes' to any of these questions and continue to join BVPT Online without the clearance of a medical practitioner, you do so at your own risk and Barossa Valley Personal Training takes no responsibility for any injury that occurs as a result.
